Re:  Your letter dated June 6, 2006 (appeal from termination heard in 1984)

Dear Mr. Shaw:

Your letter dated June 6, 2006, regarding, among other things, the Findings and Decision of our Commission upholding your 1983 termination from employment with the Sheriff’s Department of the County of Ventura was on our informational agenda for our June 22, 2006 business meeting.  At that meeting, we directed staff to bring your letter back to us on our regular agenda for July 27, 2006, along with a proposed response.  

In your letter (page 4), you state that in February 1984, the Commission agreed to an arrangement by which you were to immediately resign after first being reinstated to employment with the County and that the Commission had found “little factual basis” supporting your termination by the Sheriff’s Department.  In response thereto, the Commission can only say that a diligent search by our staff and law advisor of the records concerning your appeal failed to reveal any evidence that such was the case.  Indeed, there is no evidence even of a single communication regarding reinstatement (or any other proposed settlement of your appeal) made by a Commission member, or staff for the Commission, in February 1984, or otherwise.  Moreover, our staff’s research actually confirmed that, after five days of hearings in February and March , 1984, the Commission filed its Findings and Decisions on April 26, 1984, by which it unanimously sustained your termination and specifically found it justified, in part, due to your having knowingly made false statements in a report regarding an arrest you made in 1983. 

Finally, the Commission obviously can offer nothing of substance as to the remainder of your 10-page letter and certainly is in no position to provide a forum for you to present any contrary statements (or other matters) at this time, as requested on page 10 of your letter.  In short, your appeal has long since been “final” and the Commission is without any jurisdiction over this matter or anything to do with you former employment.
